Not just. Category 2 abuse of process was determined in all those 39 cases. That is when the justice
system itself has been abused. I am told by a barrister involved that it opens the Post Office to
claims for malicious prosecution.
The Post Office has already said it cannot afford its compensation scheme
(some £57+m was agreed out
of court before Fraser J's 2019 judgement) so the taxpayer will foot some
of it.
